Nii Apiakai I Files High Court Action Against Unauthorised Traditional Installations (GJ/0900/26)

Jonathan Yartey Boi (Nii Apiakai I), Dzaasetse and Acting Head of the Nii Boi Royal Family, has filed a Writ of Summons at the High Court of Justice, Accra, against three individuals attempting to self-install persons into traditional war-leader positions without authorisation.

Background

On 2 July 2026, Jonathan Yartey Boi — known by his stool name Nii Apiakai I — filed Suit No. GJ/0900/26 at the High Court of Justice, Accra (General Jurisdiction) against three defendants: Isaac Ayitey, Alexander Yartey Boi, and Emmanuel Yartey Boi, all of Abeka.

What the Case Is About

The plaintiff, acting as Dzaasetse and Acting Head of the Nii Boi Royal Family of Abeka, states that the defendants — who hold no recognised traditional office within the family — have been moving around Nii Boi Town claiming authority they do not possess. Specifically, they have announced their intention to install members of the community into the positions of Asafoatse and Asafoanye (traditional war leaders) — positions that fall strictly within the authority of the Nii Boi Royal Family leadership.

The plaintiff further states that the defendants have been using these self-created offices to sell family properties, which constitutes a fraudulent act against the royal family and the community.

What the Plaintiff Is Seeking

  1. A declaration that the plaintiff is the Head and Lawful Representative of the Nii Boi Royal Family and the only authority — alongside his principal elders and kingsmen — who can install anyone into traditional offices of the family.
  2. A declaration that the defendants have no capacity to install anyone into the position of Asafoatse and Asafoanye.
  3. An order directed at the Security Services (Police) to assist the plaintiff in preventing any such unlawful installations.
  4. A perpetual injunction restraining the defendants, their agents, assigns and workmen from ever installing people into traditional positions without the consent of the plaintiff and his kingsmen.
  5. General Damages.

Significance

This action reinforces the constitutional authority of the Abeka Dzaase and the kingmakers of the Nii Boi Royal Family. The Dzaasetse's office — held by Nii Apiakai I since 4 August 2013 — is the legitimate electoral and custodial authority over all traditional installations within the Abeka Stool. The 2002 Perpetual Injunction already on record further supports the structural authority of this office.

Update: Defendants Proceed Despite Pending Writ

On 3–4 July 2026 — days after being served with this Writ — the defendants held a brazen "Coronation of The Lion" ceremony at what they called "Abeka Palace", simultaneously installing an Asafoanye Naa Yarley. Both acts were done in open defiance of the pending court action.
